Terms and Conditions

Welcome to Smokey Fockers Tattoo and Smoke Shop. By accessing our website, purchasing products, booking appointments, or utilizing our services, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.

1. General Provisions

1.1 Acceptance of Terms

By using our services or website, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our services or website.

1.2 Age Restriction

Strict Age Enforcement: We are an age-restricted business.

  • Smoke Shop Products: You must be of legal age in your jurisdiction (typically 21+) to browse, reserve, or purchase tobacco, nicotine, or vaporization products.

  • Tattoo Services: You must be at least 18 years of age to receive a tattoo.

  • Identification: Valid, government-issued photo identification is required for entry into the shop and for all pick-ups and appointments. We strictly prohibit the use of our services or products by minors.

2. Smoke Shop Policy: Orders & Pick-Up

2.1 Online Reservations and Ordering

Our website allows you to browse inventory and reserve or pay for items online. By placing an order, you acknowledge that you are purchasing age-restricted products.

2.2 NO SHIPPING POLICY

WE DO NOT SHIP PRODUCTS.

  • All orders placed through our website are for In-Store Pick-Up Only at our physical location: [Insert Address].

  • We do not offer delivery or mail services. Any request to ship items will be denied.

2.3 Pick-Up Requirements

To release an order to you, the following conditions must be met in person:

  1. Physical Presence: The individual who placed the order must be the individual picking it up.

  2. Valid ID: You must present a valid, unexpired government-issued photo ID matching the name on the order to prove you meet the legal age requirement.

  3. Payment Verification: If you paid online, you must present the physical credit/debit card used for the transaction.

  4. Order Confirmation: Please have your order number or confirmation email ready.

2.4 Failure to Pick Up & Abandoned Orders

  • Orders must be picked up within 2 days of placement.

  • If an order is not picked up within this timeframe, it will be cancelled. A restocking fee of 20% may apply to any refunds issued.

  • If you arrive to pick up an order and cannot produce valid ID proving you are of legal age, the order will be cancelled and no refund will be issued (or a restocking fee will be deducted, at the shop’s discretion).

2.5 Product Disclaimer (Intended Use)

  • All glass pipes, water pipes, and smoking accessories are sold for tobacco use or legal herbal use only.

  • Any reference to “drugs” or illegal substances by a customer will result in the immediate refusal of service and removal from the premises.

  • Smokey Fockers is not liable for any misuse of products sold.

3. Tattoo Studio Policy

3.1 Appointments and Deposits

  • Deposits: A non-refundable deposit is required to book a tattoo appointment. This deposit is deducted from the final cost of your tattoo.

  • Booking: Appointments can be requested online or in-store, but are not confirmed until the deposit is paid.

3.2 Cancellation and Rescheduling

  • We require at least 48 hours notice to reschedule an appointment.

  • If you reschedule with proper notice, your deposit will transfer to the new date.

  • If you cancel with less than the required notice, or fail to show up (“No Call, No Show”), your deposit is forfeited.

3.3 Refusal of Service

The artist and the shop reserve the right to refuse service to anyone for any reason, including but not limited to:

  • Being under the influence of drugs or alcohol.

  • Poor hygiene.

  • Inappropriate or threatening behavior.

  • Skin conditions (sunburn, rashes, open wounds) in the area to be tattooed.

  • Requesting offensive or hate-speech related imagery.

3.4 Artwork and Copyright

  • Custom tattoo designs created by Smokey Fockers artists remain the intellectual property of the artist.

  • Flash designs are sold as-is and may be tattooed on multiple clients unless specified as a “one-off.”

3.5 Health and Safety

  • You will be required to sign a Consent and Waiver form prior to the procedure.

  • You must disclose any medical conditions (e.g., diabetes, hemophilia, blood-borne pathogens) prior to the appointment.

  • Aftercare: We provide aftercare instructions. Smokey Fockers is not liable for infections or healing issues resulting from failure to follow these instructions or poor hygiene after leaving the shop.

4. Returns and Refunds

4.1 Smoke Shop Items

  • All Sales Final: Due to sanitary reasons, all sales on glass, mouthpieces, vapes, and consumables are FINAL.

  • Electronics: Defective electronic devices (batteries/mods) may be exchanged within 24 hrs of purchase with the original receipt and packaging, subject to testing by staff.

  • No Returns on Used Items: Under no circumstances will we accept a return on an item that has been used.

4.2 Tattoo Services

  • Tattoo services are non-refundable.

5. Limitation of Liability

To the fullest extent permitted by law, Smokey Fockers Tattoo and Smoke Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use our services.

  • The conduct of other customers or third parties.

  • Any allergic reactions to tattoo inks, metals, or vape products (customers are responsible for knowing their own allergies).

6. Indemnification

You agree to indemnify and hold harmless Smokey Fockers, its owners, employees, and artists from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of our products, services, or violation of these Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
